ASYLUM & REFUGEE PROTECTION

Overview

Asylum and refugee protection are available to people who have suffered persecution, or who have a well-founded fear of persecution, on account of race, religion, nationality, political opinion, or membership in a particular social group. Refugees apply from outside the United States; asylum seekers apply from within the U.S. or at a port of entry.

Key points

Asylum may be sought affirmatively (filed with USCIS) or defensively (as a defense in removal proceedings before an immigration judge). There is generally a one-year filing deadline for asylum after arrival, with limited exceptions. Successful applicants may eventually apply for permanent residence, and certain family members may be included.
